Terms of use - registered users - nbn® foundations


Introduction

Welcome to nbn® Foundations. By registering an account to access or use the nbn Foundations training site, you are entering into a legally binding agreement with nbn co Limited (ABN 86 136 533 741) (nbn, we, us and our). In consideration of your access to and/or use of nbn Foundations, you agree to comply with these Terms of Use.

nbn Foundations is part of the nbn Trained Consultant program and is available to individuals working or intending to work with a developer for a new development comprising SDU (single-dwelling unit), MDU (multi-dwelling unit), or HMDU (Horizontal Multi Dwelling Unit) premises, where the developer is also a recognised builder or owner builder (the Developer).

The individual is the Developer's representative, seeking the relevant training and subsequent accreditation to undertake the following activities in connection with infrastructure that will form part of the nbn® access network:

  • Pit & Pipe designs: Individuals that undertake pit & pipe design work for Developers, and are competent in using technical drawing software.
  • Pit & Pipe installations: Individuals that undertake pit & pipe installation work for Developers. It is highly recommended that they are also competent installing Pit & Pipe in accordance with nbn’s design and build standards (as updated from time to time) located on nbn’s website.
  • MDU (multi-dwelling unit) pathway designs: Individuals that undertake MDU pathway design work for Developers and are competent in using technical drawing software.  

1. Definitions

a. "Content" refers to all materials, documents, videos, and other resources available on the Platform.

b. “Indirect Loss” means loss of revenue, loss of profit, loss of goodwill, loss of anticipated savings, loss of opportunity, and any other Loss, not arising naturally and according to the usual course of things from the relevant breach, whether or not such Loss may reasonably be supposed to have been in the contemplation of both parties, at the time of entry into these Terms of Use, as the probable result of the relevant breach.

c. “Loss” means any loss, damage, liability, charge, expense, outgoing, cost, fine, payment (including all legal and other professional costs on a full indemnity basis) of any nature.

d. "nbn" means NBN Co Limited (ABN 86 136 533 741).

e. “nbn® Brand” means nbn Brand as defined in the nbn Brand Approved Use Terms.

f. “nbn® Brand Approved Use Terms” mean any conditions or guidelines (as updated from time to time) for the use of nbn’s names, marks and symbols, including product identifiers provided to you by nbn. As at the date of these Terms of Use, the nbn® Brand Approved Use Terms for Property Developers and nbn Trained Consultants dated February 2026. 

g. “nbn® trained brands” means nbn trained brands as defined in the nbn® Brand Approved Use Terms.

h. “nbn Foundations” refers to the nbn New Developments training program on the Platform. 

i. “nbn Foundations ID” means the numerical identification number allocated to a User once registration has occurred on the Platform. 

j. “nbn New Developments Portal” means the online nbn New Developments portal for, but not limited to, Developer communications and Developer nbn New Development application forms and monitoring of existing nbn New Development application forms. 

k. nbn Trained Consultant program means the nbn program available to consultants for nbn training and accreditation of development designs and installations to nbn’s standards.

l. “Personal Information” has the meaning given to that term in the Privacy Act 1988 (Cth).

m. "Platform" refers to the nbn Academy online learning management system.

n. "Premium” means a User that has achieved and holds Premium accreditation in nbn Foundations in accordance with these Terms of Use. 

o. “Trained” means a consultant that has achieved and holds Trained accreditation in nbn Foundations in accordance with these Terms of Use. 

p. "User" (you or your) refers to an individual or entity with a registered account that may access or use the Platform.

2. User accounts

a. Registration: Users must register for an account to access certain features of the Platform. You agree to provide accurate and complete information during registration. It is your responsibility to inform us of any changes to your information. You may do this at any time by accessing your user account.  By registering a user account, you consent to nbn and its contracted service providers sending you emails regarding your use of the Platform.

b. Account security: you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us if the confidentiality of your account credentials is compromised by sending an email to nbn at the address set out in clause 14.

c. nbn foundations ID: you may use your numerical identification on all design and/or practical completion notice submissions, which may be entered by the User’s administrative staff on the nbn New Developments Portal but must not be shared with other users of the Platform. 

3. Use of the platform

a. Permitted use: you agree to only use the Platform for educational and training purposes related to nbn infrastructure design and build requirements for New Developments and in accordance with these Terms of Use and only for the period that nbn permits such access or use (as determined in nbn’s sole discretion).

b. Restrictions on use: you must not use the Platform for any unlawful or unauthorised purpose, including but not limited to:

i. for any purpose other than as permitted by these Terms of Use;

ii. to engage in any activity which breaches any law, or infringes nbn’s or a third-party’s intellectual property rights including removal or tampering with any copyright notices on the Platform;

iii. introducing and/or distributing any harmful or malicious software;

iv. engaging in any activity that disrupts or interferes with the Platform's functionality; 

v. accessing or attempting to access another users' account without authorisation; or

vi. in any way that constitutes misuse, or resale or other commercial use, of the Platform including any Content.

c. Third-party services: the Platform may include third-party software, products, services, features or content (Third Party Services). You agree to be bound by and will comply with any applicable third-party terms notified to you by nbn in respect of your use of the Platform and acknowledge and agree that nbn is not responsible for Third Party Services.

4. Content

a. Ownership: All Content on the Platform including copyright and other intellectual property rights in the text, graphics, information, designs, data, and other content is owned by nbn (and/or its third-party licensors).

b. Use of nbn branding: nbn may consent in writing for you to use the nbn® trained brands for the approved uses specified in the nbn® Brand Approved Use Terms and in accordance with these Terms of Use, and you acknowledge and agree:

i. you must not use the nbn® trained brands unless you are accredited Trained or Premium and must only use the approved nbn® trained brand applicable for your accreditation status and agree to comply with the nbn® Brand Approved Use Terms; and

ii. to indemnify nbn in respect of any loss, damage, costs and claims arising from your use of the nbn® Brand including nbn® trained brands.

c. Restrictions: you must not reproduce, distribute, modify, or create derivative works from the Content without obtaining nbn’s prior written consent.

d. Your content: you grant us an irrevocable, perpetual, non-exclusive, worldwide, royalty-free, sub-licensable licence to use, reproduce, adapt, modify, communicate, and publish all content that you submit on the Platform. You warrant to us that you have the necessary rights to grant this licence

5. Privacy

a. Data collection: nbn collects and processes Personal Information in accordance with nbn’s Privacy Policy.  nbn’s Privacy Policy forms part of these Terms of Use. By accepting these Terms of Use and using the Platform, you consent to such collection and processing. 

b. Data security: you acknowledge and agree to the extent permitted by law, while nbn implements reasonable security measures to protect User data, nbn does not represent, warrant or guarantee that the Platform is free from any security risk including but not limited to computer viruses or any other defect or error which may affect your software or systems. 

6. Disclaimers and limitations of liability

a. Disclaimers: you acknowledge and agree that access to and all Content available on the Platform is provided to you on an ‘as is’ and ‘as available’ basis. You acknowledge and agree that to the extent permitted by law, nbn does not make any representations, warranties, or guarantees in relation to the availability, suitability, continuity, reliability, accuracy, completeness, currency, or security of the Platform including the Content. nbn will not be liable if the Platform (including any Content) is incomplete, corrupted, inaccurate, outdated or is unavailable for any reason.

b. Third-party sites: the Platform may contain links or references to third-party sites. nbn is not responsible or liable for the content of those sites and your access to and use of those sites is at your own risk. Any links are provided for your convenience only, and do not indicate any endorsement or recommendation by nbn.

c. Indemnity: You indemnify nbn against any Loss which it suffers, incurs or is liable for arising out of or in connection with: 

i. any breach of these Terms of Use or any laws, or infringement of any nbn or third-party intellectual property rights, by you;

ii. any act of fraud or wilful misconduct, or misrepresentation, by you;

iii. any misuse of your user account, by you or any third-party whilst using the Platform;

iv. any claim by a third-party relating to your use of the Platform (or use by any person who accesses the Platform using your user account) or any claim relating to the infringement of any third-party intellectual property rights.

d. Limitation of liability: To the maximum extent permitted by law, nbn’s aggregate liability to you arising under and in connection with these Terms of Use (whether in contract, tort (including negligence), statute, equity or otherwise) is limited to nbn’s costs for providing you access to the Platform during the Trained Consultant Period. Neither party is liable for any Indirect Loss suffered in connection with these Terms of Use, whether arising under contract, tort (including negligence), statute, equity or otherwise.

7. Misuse and consequences

a. You must not claim work that is not your own. Doing so may result in a review of your accreditation by nbn.  nbn may, in its discretion, acting reasonably:

i. suspend your access and/or terminate your user account including removal from the nbn Trained Consultant program and nbn Trained Consultant List; and/or 

ii. require you to undertake further training within a reasonable period of time. 

b. You acknowledge that misusing a nbn Foundations ID may result in a suspension and/or termination of your user account and suspension or removal from the nbn Trained Consultant program and nbn Trained Consultant List. 

c. During a period of suspension, you and your employer must not represent yourselves as accredited, as either nbn Trained or Premium. 

d. nbn may suspend your access at any time, without notice where we have deemed you to be ineligible, or we consider it necessary to manage a potential fraud, privacy, security, or other risk. nbn may deem you to be ineligible to access and use the Platform, participate in the nbn Trained Consultant program, and/or be placed on the nbn Trained Consultants List, in its sole discretion, if any of the following circumstances apply: 

i. you are in breach of these Terms of Use and failed to remedy the breach within a reasonable time after nbn gives you notice of the breach;

ii. you are in breach of any law, or infringed any intellectual property rights of nbn or a third-party; 

iii. we have evidence that you have or are suspected to have engaged in fraudulent behaviour; 

iv. we consider there to be a privacy, fraud, security, safety, or other risk associated with your continued access and use of the Platform, participation in the nbn Trained Consultants program, or placement on the nbn Trained Consultant List; or  

v. you have a duplicate user account, or your user account has been inactive for 24 months, and you have not responded to any attempts by nbn to contact you.

e. You acknowledge any suspension will continue until the breach is remedied or the risk is resolved to nbn’s reasonable satisfaction or if nbn terminates your user account. nbn reserves its right to exercise any right to terminate your user account on the Platform during a period of suspension.

8. Termination

a. Termination by user: you may terminate your user account at any time by contacting nbn support in writing with a notice period of 10 business days. 

b. Termination by nbn: nbn may terminate your user account immediately by giving written notice to you:

i. if you fail to remedy any breach of these Terms of Use within a reasonable time of nbn giving notice of the breach to you or where the breach is incapable of remedy; or 

ii. for any other reason at nbn’s sole discretion.

c. Consequences of termination: if either you or nbn terminate your user account, you will be removed from the nbn Trained Consultants program and nbn Trained Consultant List and must immediately cease the use of any approved use of the nbn® Brand, or nbn® trained brands under the nbn® Brand Approved Use Terms unless nbn provides its written consent, effective on the date of termination.

9. Quality

You acknowledge that: 

a. nbn may review the quality of work you provide to nbn.

b. where nbn reasonably deems the work to be of poor quality you may be: 

i. suspended and/or removed from the nbn Trained Consultant List; 

ii. required by nbn to undertake further training; and/or 

iii. subject to other reasonable action by nbn for the purpose of ensuring the quality of the work. 

c. all design, as built, practical completion notices submissions, must include your nbn Foundations ID number and which will be reviewed and assessed by nbn. 

d. all Trained and Premium accredited consultants will receive a quality score for all design or practical completion notice submissions as determined by nbn having regard to nbn’s quality management system including the quality assurance criteria outlined below.  This rating will be used to determine if any future audits are reasonably required and will not be published publicly. 

e. if you are a pit and pipe installer, you must undertake self-audits using an approved nbn Checklist in accordance with the timeframes outlined in your Developer’s agreement or such other timeframe reasonably required by nbn and provide the results of these audits to nbn via the nbn New Developments Portal. 

Quality assurance

To ensure designs and installs are of a high quality, nbn reviews and inspects work. When work is reviewed and inspected depends on your accreditation and is outlined below.

Trained accreditation

  • 100% of designs are reviewed before design acceptance.
  • 100% of installations are inspected before practical completion certification.

Premium accreditation 

  • No review of designs is undertaken before acceptance. However, nbn will review 100% of designs post acceptance as part of nbn’s quality assurance. 
  • 100% of installations are inspected before practical completion certification.

You acknowledge that design acceptance does not negate liability or responsibility to take corrective actions or remediation of any errors, omissions, or non-compliance with the nbn design and build standards identified after design acceptance.

You acknowledge that the quality of the work submitted remains the responsibility of the individual who is claiming the New Developments task under their nbn Foundations ID. If corrective actions or remediation is required to any work you have submitted or been involved in, post design acceptance or practical completion certification, nbn will notify you via the nbn New Developments Portal.

Quality standards

a. Designs: If more than 50% of your design submissions require corrective actions within a 12-month period, nbn may review your accreditation and where nbn reasonably deems the work to be of poor quality, nbn may in its discretion: 

i. suspend and/or remove you from the nbn Trained Consultant List; 

ii. require you to undertake further training; and/or 

iii. require any other reasonable action for the purpose of ensuring the quality of the work. 

b. Installs: If more than 50% of installations by you contain defects (other than minor defects reasonably determined by nbn, being defects that do not hinder the reasonable use of the installation for their intended purpose, and that can be rectified without hindering the reasonable use of the installation by nbn (Minor Defects)) and where nbn reasonably deems the work to be of poor quality, nbn may in its discretion: 

i. suspend and/or remove you from the nbn Consultant List; 

ii. require you to undertake further training; and/or 

iii. require any other reasonable action by you for the purpose of ensuring the quality of the work.

10. nbn trained consultants list

You acknowledge the following: 

a. To achieve and maintain Trained accreditation individuals must:

i. Training criteria: Log in and complete learning every 12 months. The renewal date will be based on the completion of the acceptance criteria referred in a.ii. below.

ii. Acceptance criteria. Use their nbn Foundations ID in nbn New Developments Portal task and submit at least 12 designs or certified installations within a 12-month period.

b. To graduate from Trained to, or to maintain, Premium accreditation, individuals must:

i. Training criteria: Log in and complete learning every 12 months. The renewal date will be based on the completion of the acceptance criteria referred in b.ii. below.

ii. Acceptance criteria: Use their nbn Foundations ID in nbn New Developments Portal tasks and submit at least 20 designs or certified installations within a 12-month period.

iii. 80% of design submissions are accepted first time with no corrective actions.

iv. 80% of installations are certified first time with no defects (other than Minor Defects). 

c. Once you have achieved and/ or maintained Trained or Premium accreditation, you and/or your company will be placed on the nbn Trained Consultant List with your accreditation status, subject to these Terms of Use; 

d. your company’s contact details will be visible on the nbn Trained Consultant List on nbn’s website. You must seek permission from your employer in relation to your details and your company’s details appearing on the nbn Trained Consultant List and advise nbn if your company does not wish for this information to be included on that list. 

e. you are responsible for ensuring that your employment information is kept up to date and you must notify nbn of any changes within 14 business days. A company must also notify nbn of any accredited individual’s departure within 14 calendar days of the departure date. Notifications must be submitted in writing to nbn Foundations: foundations@nbnco.com.au

f. you warrant that the employment information provided to nbn is accurate and correct. nbn may verify your employment information and carry out any background checks if deemed reasonably necessary.

g. nbn provides nbn trained accreditation to individuals who have successfully completed the training and acceptance criteria for Trained or Premium accreditation. 

h. nbn’s training does not extend to training on the design or the product itself, or the company in which the individual is employed, nor does it indicate that an individual has necessary industry qualifications; and

i. you acknowledge that any completed training and accreditation conferred does not constitute any approval or endorsement by nbn of you or your company or the goods and/or services that you or your company provide.

11. Renewal and training compliance

You acknowledge that: 

a. the duration of the accreditation period is 3 years (Trained Consultant Period); and

b. to remain compliant during the Trained Consultant Period, you must complete the refresher training nominated by nbn, every 12 months. You will be notified via your registered email to complete the training 2 months prior to the end of each 12 month period. Failure to complete the refresher training is a breach of these Terms of Use. If you fail to complete the refresher training within a reasonable time after nbn gives notice to you, nbn may review your accreditation and at its discretion, it may suspend and/or terminate your user account and your accreditation including your placement on the nbn Trained Consultants List.  

12. Transition period

a. You acknowledge and agree that these Terms of Use will replace the previous accreditation program enAble Terms of Use – Registered Users, upon acceptance of these Terms of Use by you. 

b. To support a smooth transition, a transition period will apply until 17 February 2027 (Transition Period).  During the Transition Period: 

i. enAble  accredited individuals and entities will maintain the same accreditation status on the nbn Trained Consultants List and may continue to use their existing accreditation status; 

ii. Companies may continue to claim company accreditation based on existing accredited individuals who have maintained employment with them. 

c. At least 3 months prior to the expiry of the Transition Period, nbn will notify you of your nbn Foundations accreditation status that will be effective on the expiry of the Transition Period. 

d. At the conclusion of the Transition Period:

iii. accreditation under enAble will cease and no longer apply; and 

iv. all individuals and companies must meet the requirements set out in these Terms of Use to achieve and/or maintain Trained or Premium accreditation status. 

13. General

a. Change of terms: nbn reserves the right to modify these Terms of Use at any time. If nbn updates these Terms of Use, the updated terms will be presented to you when you next access the Platform. You must accept the updated terms to continue using the Platform.  If you do not accept the updated terms, you must immediately cease using the Platform and close your user account by sending an email to foundations@nbnco.com.au

b. Governing law: these Terms of Use are governed by and construed in accordance with the laws of New South Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

c. No assignment or other dealing: you must not assign, sublicense, or otherwise deal in any other way with any of your rights under these Terms of Use. 

d. Severability: if a provision of these Terms of Use is invalid or unenforceable, it may be severed and the remaining provisions of these Terms of Use continue in force.

e. Entire agreement: these Terms of Use are the entire agreement between you and nbn on its subject matter and supersede any previous arrangements, agreements, representations, understandings, or statements (whether verbal, in writing or in some other format).

Data collection notice

nbn is collecting your Personal Information to enable us to deliver training. If you do not provide us with this information, we will not be able to process your request. 

Our privacy policy contains detailed information about our information handling practices, how you may access, update and correct Personal Information we hold about you and how we may engage suppliers outside of Australia. If you are concerned about how we have handled your information, the policy also sets out how to lodge a complaint.
